1. Agreement to Terms

By accessing or using our website and services, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you must discontinue use of our services immediately.

XProxy reserves the right to update or modify these terms at any time without prior notice. Your continued use of the services following any changes constitutes your acceptance of the revised terms.

2. Intellectual Property

All content on this site — including text, graphics, logos, images, software, and other materials — is the proprietary property of XProxy and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive license for personal, non-commercial use only. Any other use requires our prior written consent.

3. User Representations

By using our services, you represent and warrant that:

• All registration information you provide is accurate, current, and complete.
• You are at least 18 years of age.
• Your use of the services does not violate any applicable law or regulation.
• You will maintain the accuracy of your account information and update it as necessary.

4. User Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

XProxy reserves the right to reclaim, suspend, or terminate any username that is deemed inappropriate, offensive, or in violation of these terms.

5. Prohibited Activities

You may not use our services for any unlawful purpose or in any way that could harm XProxy or other users. Prohibited activities include, but are not limited to:

• Using the services for any illegal purpose or in violation of any applicable laws.
• Impersonating any person or entity, or misrepresenting your affiliation with any person or entity.
• Sending unsolicited communications (spam) or engaging in any form of harassment.
• Uploading or transmitting viruses, malware, or any other harmful code.
• Using automated tools to scrape, crawl, or extract data from our services without permission.
• Launching denial-of-service (DoS or DDoS) attacks against our infrastructure.
• Interfering with or disrupting the integrity or performance of our services.

6. User Generated Contributions

If you submit, post, or transmit any content through our services, you represent that such content:

• Does not infringe any third-party intellectual property rights.
• Does not contain false, misleading, or defamatory information.
• Is not obscene, offensive, or otherwise objectionable.
• Does not harass, threaten, or intimidate any individual.
• Does not violate any applicable law or regulation.

7. Contribution License

You retain ownership of any content you submit to our services. However, by submitting feedback, suggestions, or ideas to XProxy, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, and distribute that feedback for any purpose, without compensation to you.

8. Mobile Application License

If you access our services through a mobile application, we grant you a limited, revocable, non-transferable license to install and use the application on your personal device. You may not:

• Reverse engineer, decompile, or disassemble the application.
• Modify, adapt, or create derivative works based on the application.
• Use the application for any commercial purpose or competitive analysis.

9. Submissions

Any ideas, suggestions, or other materials you voluntarily submit to XProxy — outside of content posted through the services — become the sole property of XProxy. We acquire all intellectual property rights to such submissions and are not obligated to keep them confidential or compensate you for them.

10. Site Management

XProxy reserves the right to monitor the services for violations of these terms, take appropriate legal action against violators, restrict or deny access to any user at our sole discretion, and remove or edit content that we determine to be in violation of these terms or otherwise objectionable.

11. Privacy Policy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms of Use by reference. Our services are hosted in the United States. If you access our services from outside the United States, you consent to the transfer and processing of your data in the United States.

12. Term and Termination

These terms remain in effect for as long as you use our services. XProxy reserves the right to deny access to, suspend, or terminate your account at any time, for any reason, without prior notice or liability. Upon termination, your right to use the services will immediately cease.

13. Modifications and Interruptions

XProxy reserves the right to change, suspend, or discontinue any part of the services at any time without notice. We are not liable for any loss or inconvenience resulting from service modifications, downtime, or discontinuation.

14. Corrections

XProxy may correct typographical errors, inaccuracies, or omissions on the site at any time without prior notice. We are not obligated to update information unless required by law.

15. Disclaimer

Our services are provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied. XProxy expressly disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or free of viruses or other harmful components.

16. Limitations of Liability

To the fullest extent permitted by law, XProxy and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of or inability to use our services, even if we have been advised of the possibility of such damages.

17. Indemnification

You agree to defend, indemnify, and hold harmless XProxy and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising from your use of the services, your violation of these terms, or any harmful act you commit in connection with the services.

18. User Data

XProxy may retain certain data you transmit through the services for the purpose of managing service performance. You are solely responsible for all data you transmit and any activity conducted through your account. XProxy is not liable for any loss or corruption of your data.

19. Software

Any software provided through our services is offered on an "as-is" basis under a limited, non-exclusive, revocable license, unless a separate end-user license agreement (EULA) applies. No other rights are granted.

20. Cancellation

You may cancel your software subscription at any time through your account settings. Upon cancellation, you may terminate the subscription immediately to claim a pro-rated refund for the remaining unused days. This pro-rated refund is credited instantly to your XProxy Account Balance (Wallet) for future use.

21. Unauthorized Use

Any unauthorized use of our services or software is strictly prohibited. You will be held financially liable for any damages — including lost revenue and legal costs — resulting from unauthorized use.

22. Software Modification and Plugins

Any attempt to modify, crack, reverse engineer, or create unauthorized plugins for XProxy software will result in the immediate termination of your license. You may also be held financially liable for damages resulting from such actions.

23. Transfer of License

Licenses granted under these terms are personal to you and are non-transferable and non-resellable. Any attempt to transfer, sublicense, or resell your license will result in its immediate termination.

24. Warranty

XProxy hardware products carry a 12-month limited warranty from the date of purchase. This warranty covers manufacturing defects under normal use conditions. The warranty is voided by:

• Physical damage caused by misuse, accidents, or unauthorized modifications.
• Use of unofficial or incompatible power supplies.
• Exposure to extreme environmental conditions (heat, moisture, etc.).
• Tampering with internal components.

25. Shipping Policy

Estimated delivery time is 1 to 6 weeks depending on your location. Customers are responsible for all applicable customs duties, import taxes, and clearance fees. It is your responsibility to ensure that the products you order are permitted for import in your country.

26. Shipping and Delivery Issues

If a package is uncollected, refused at delivery, or fails customs clearance, it may be returned to us at the buyer's sole expense. Specifically, if a shipment is refused at delivery, uncollected, rejected by customs, or denied entry while the order status is still in transit (not yet successfully delivered), XProxy does not accept returns, issue refunds, or bear any cost responsibility under any circumstances for such delivery, refusal, or customs failures.

We cannot process or accept returned goods if the package has not been successfully delivered first. Once an order has been successfully delivered, any return requests and applicable return/refund costs are governed strictly by Section 27. Return and Refund Policy.

Repeated delivery failures — including refusal to receive delivery or pay customs fees — may result in a permanent ban from placing future orders.

27. Return and Refund Policy

Hardware products may be eligible for return within 14 days of successful delivery. All returns are subject to a restocking fee equal to 30% of the total order value. To qualify for a return, the goods must be in their original, unmodified condition and original packaging. Returns are strictly not accepted if the product has not been successfully delivered first (e.g., packages uncollected, refused at delivery, or blocked/rejected by customs during transit).

The buyer is solely responsible for covering all fees associated with returned orders, including two-way shipping fees (both original shipping costs and return shipping costs) and any payment processing or gateway fees incurred during the purchase and refund transactions.

All returned hardware must be shipped back to our designated facility in Texas, USA. The exact return shipping address will be provided to the buyer once the return process is officially approved and initiated.

All software licenses and service payments are non-refundable to external payment methods once activated or used; however, immediate cancellation of active subscriptions will credit a pro-rated refund of the unused balance back to your XProxy Account Wallet.

Funds in your XProxy Account Wallet may be used to purchase hardware products, subject to verification by XProxy that the funds do not consist of promotional credits, bonuses, or other non-purchased balances. XProxy Wallet deposits (funds deposited by user) can only be refunded/withdrawn to external payment methods if the deposit was made within 7 days (1 week) of the refund request, and provided that the account has never purchased and subsequently canceled any software subscription using those funds.

28. Electronic Communications

By using our services, you consent to receive electronic communications from XProxy. You agree that all agreements, notices, and disclosures provided electronically satisfy any legal requirement that such communications be in writing. You also consent to the use of electronic signatures and records.

29. Miscellaneous

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and XProxy regarding your use of the services. If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect. XProxy may assign its rights and obligations under these terms without restriction. Your failure to exercise any right under these terms does not constitute a waiver of that right.
